Philip’s extensive commercial counsel experience over 45 plus years encompasses a broad spectrum of issues regarding the ownership, development, construction and operation of domestic and international energy (oil and gas, mining as well as renewable energy) projects.

.His considerable major projects experience encompasses a majority of the massive multi-billion dollar oil sands projects in northern Alberta, major SAGD projects as well as various international projects in the Middle East, Africa (including the multi-billion dollar Greater Nile project in the Sudan) and Indonesia – and it spans a broad range of engineering, EPC, EPCM, construction, major equipment design, fabrication and supply agreements as well as process licensing agreements (including, where applicable, the associated performance guarantee/testing regimes) involving various international and domestic contractors, suppliers and licensors.

His oil sands experience includes the Horizon and Albian Oil Sands projects that are operated by Canadian Natural Resources Limited where his extended involvement encompassed the Horizon 10 billion dollar phase 1 construction, the subsequent Horizon multi-billion dollar phase 2 expansion as well as certain critical infrastructure elements for both projects.. The Horizon project represents one of the largest EPC projects constructed in Canada whereby the owner directly contracted and managed multiple EPC contractors in relation to the engineering, construction and commissioning of the various respective silos/segments that collectively comprised the overall project . His Horizon related efforts included the capital intensive upgrading silo – including certain contracts with major international EPC contractors as well as foreign based specialized major equipment suppliers of various long lead items - other project silos as well as various major aspects of the Horizon project infrastructure that included the contractual framework for the capital intensive flight program between the Horizon Aerodrome and various cities across Canada which supported the 10,000 person phase 1 construction work force. His extended involvement encompassed the relevant critical aviation related infrastructure for both projects and the contractual framework for the fly-in/ fly-out program that was adopted in order to support the Horizon and Albian 24/7 operations, including the combined 4500 person regular work force as well as up to the additional 4,000 person work force which carries out the scheduled maintenance shutdowns.

Philip’s recent major projects experience includes the strategic overviews he provided regarding various EPC contracting and risk mitigation strategies for three major pending international energy projects.

His oil and gas experience spans Canada as well as Indonesia, the Middle East, Pakistan and Africa - and a broad range of ownership, development and operational issues including acquisitions/dispositions, transportation agreements, long term natural gas sales agreements as well as various operating agreement and production sharing contract regime related issues. His domestic and international oil and gas clients include apart from various Canadian companies a cross section of major US, European and Asian companies that include ExxonMobil, Conoco Phillips, Amerada Hess, AGIP/ENI and Nippon Oil.

Philip’s mining experience includes various gold and base metal projects in Canada, Indonesia, Africa and the Philippines and most recently the evaluations that he provided regarding the potential re-structuring of the joint venture agreements for certain major foreign based operating mines as well as the counsel he provided regarding the joint venture agreement for a pending new project. His legacy mining experience includes assisting major European and American energy companies as well as certain foreign owned utility companies in their Canadian uranium exploration and development activities all of which encompass the preparation of the initial joint venture agreement for the MacArthur River mine, currently the world’s largest high grade uranium mine project, as well as the joint venture agreements for two other proposed advanced stage Canadian uranium projects that ultimately did not proceed to commercial development.

Philip’s renewable energy experience includes the preparation of the heads of agreement for the joint venture agreements regarding two major proposed foreign based renewable energy projects that are being evaluated.

Philip has been involved with and supported many leading international professional organizations including among others the Rocky Mountain Mineral Law Foundation, the Association of International Petroleum Negotiators, the UK Society of Construction Law, the American Bar Association Forum on Construction Law as well as the Oil & Gas, Mining Law and International Construction Projects Committees of the Energy, Environment, Natural Resources and Infrastructure Law Section of the International Bar Association.
